This is NOT a Driver Aid and should never be engaged while a vehicle is in motion.

You agree to only use this product and software when you have determined all conditions to be safe and legal; and accept full responsibility for your use thereof.

Please carefully read these terms and conditions of this User Agreement, along with those of other affiliated products and services of Better Mousetrap, LLC, which may be affiliated or interact with this product, App, software, including report generating services, if applicable (“Product”) including those on the company’s websites and privacy policy, before using this Product. By accessing or using the Product, you (“User”) agree to be legally bound by these terms and conditions. If you disagree with any of the following terms or conditions, you are not authorized to use this Product.

Better Mousetrap, LLC (“Company”) owns and operates the Product and affiliated services and reserves the right to change any software, terms or conditions without notice, effective upon their posting and updates. YOU ARE RESPONSIBLE FOR REGULARLY UPDATING THIS PRODUCT, AND MAY ONLY USE THE MOST RECENT AND SUPPORTED VERSION AS POSTED ON THE COMPANY’S WEBSITE, ACCORDING TO THE TERMS AND CONDITIONS CONTAINED THEREIN.

Ownership of Intellectual Property Rights

All text, photographs, images, illustrations, artwork, audio and video clips, design, software, graphic material, trademarks, service marks and trade names, and all intellectual property rights in and to such items contained within the Product (hereinafter “Content”), including any modifications, variation and/or derivative works thereof, constitute the sole and exclusive property of Better Mousetrap, LLC or its subsidiaries, affiliates and licensors.

USER EXPRESSLY AGREES THAT USE OF THE PRODUCT IS AT USER’S SOLE RISK. NEITHER BETTER MOUSETRAP, LLC, ITS PARENTS, AFFILIATES, EMPLOYEES, AGENTS, SERVICE PROVIDERS, THIRD PARTY INFORMATION PROVIDERS, LICENSORS OR THE LIKE, WARRANT THAT THE PRODUCT WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY, OR MAY NOT, BE OBTAINED FROM THE USE OF THE PRODUCT, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION OR SERVICE CONTAINED IN OR PROVIDED THROUGH THE PRODUCT OR ANY RESULTING REPORTS. USER AGREES THAT THE ACCIDENTPLAN SERVICE AND APP WILL NOT BE USED AS THE PRIMARY, OR SOLE METHOD OF CONTACTING OTHERS IN AN EMERGENCY; AND USER FURTHER CONSENTS THAT THE EMERGENCY NOTIFICATION FEATURE IS ONLY INTENDED AS A BACK-UP METHOD OF CONTACT FOR THE ADMINISTRATIVE CONVENIENCE OF THE USER, AND USER FULLY ACCEPTS THE RISK THAT THE EMERGENCY CONTACT FEATURE OR SERVICE MAY BE INTERRUPTED FROM TIME TO TIME. USER CONSENTS AND AGREES THAT ALL INFORMATION SUBMITTED THORUGH THE APP, INCLUDING, BUT NOT LIMITED TO PHOTOS, TEXT, AUDIO RECORDINGS AND OTHER RESPONSES WILL NOT BE STORED ON THE USER’S MOBILE DEVICE AND MAY, OR MAY NOT, BE STORED ON THE COMPANY’S SERVERS, AND MAY OR MAY NOT BE ACCESSIBLE TO THE USER AT A LATER DATE. COMPANY IS NOT RESPONSIBLE FOR INTERURRUPTIONS IN TRANSMISSIONS BETWEEN USER & USER’S DEVICE, EMERGENCY CONTACTS AND COMPANY’S SERVERS; NOR FOR ACCESS OR RELIABILITY OF THIRD PARTY TRANSMISSION SERVICES SELECTED BY THE USER; AND COMPANY IS NOT RESPONSIBLE FOR LOST OR INACCESSIBLE DATA OR FILES THAT MAY, OR MAY NOT, HAVE BEEN GATHERED BY USER, OR STORED BY COMPANY. USE OF THIS PRODUCT WITHOUT A VALID, AUTHENTICATED LICENSE, AS A DEMO, IN TEST MODE AND/OR AS A GUEST USER WILL NOT RESULT IN EMERGENCY NOTIFICATIONS, ANY SAVED DATA NOR FINAL REPORT.

By using this Product, you have accepted all of the terms and conditions of this Product and affiliated services and agree to be bound to them as written, or updated by Company.

AccidentPlan Privacy Policy

AccidentPlan may change this policy from time to time, so be sure to regularly review it in order to stay current.
AccidentPlan will never sell your information to third parities without your permission. When you decide to sign up for an account by submitting such things as your name, address, phone number and email address, we will only use that information to communicate with you and personalize your account within our system. We may hang on to the correspondences that you email or otherwise send to us for future reference; and we may track your browsing and clicking activities on our website for statistical analysis. But we will never use your name, or the specific data you provide to us, for marketing purposes.

AccidentPlan may collect information from third parties with whom we have strategic partnerships such as telematics providers and video providers and host it on our servers. This policy applies to ALL data collected by AccidentPlan whether submitted by the user directly or a strategic partner.

We intend to use your information to provide you with the products and services you request, which may involve full or partial disclosure to third parties from time to time. But we reserve the right to provide your information to third parties if it may help in the investigation and/or prevention of a crime, or threat or injury to any person; and if we are required to by law.

When you use our AccidentPlan app to gather information from your accidents in remote locations, you will generate data that will be stored on our servers according to our terms of service. This is your data, and we have no intention to disclose it to law enforcement officials, or third parties, without a court order, or your permission when applicable. We will send an email notification to the designated person on your account when others request your data, or when a court orders us to disclose your information.

In addition, we may access this data to work on our software or servers from time to time.

We will delete your information within 30 days if you delete your account with us. If you decide not to renew a subscription for service, or if your account becomes inactive for other reasons with us, your data may be deleted at any time.

AccidentPlan is now owned by Better Mousetrap, LLC and may be merged or acquired by another entity in the future. If any such changes to our future involve transferring your information to another entity, we will send an email notification to the designated person on your account
